Civil litigation incorporates areas of contract law, tort law, and other forms of suit.
Civil litigation usually involves disputes of private law between individuals, businesses or non-profit organizations, but may also entail public law.
For the most part there are three basic steps to a civil litigation suit. First, the plaintiff will file a written complaint. Next, in order to make any kind of plea, the defendant will respond with a written “answer” to the complaint. Finally, the suit enters its “discovery” process in which both parties are exposed to all the facts regarding the suit such as witness questionings, exchange of documents, interrogations, etc.
Because civil litigation is a dispute between two private parties or entities, the decision is not handled as a criminal procedure. However, having proper representation is very important.
Some examples of civil litigation suits include, but are not limited to:
- Tort claim
- Worker’s compensation
- Employee grievance appeals
- Discrimination claims
- Civil claims
